How to Get an FIR Registered in UP

A First Information Report (FIR) is the first formal record of a cognizable offence and triggers police investigation. This guide explains the procedure for getting an FIR registered in Uttar Pradesh, and your options if the police refuse.

How can someone get an FIR registered in Uttar Pradesh?

An FIR is registered under Section 173 of the BNSS, 2023 at the police station with jurisdiction over the place of the incident. The complainant provides information orally or in writing; the officer records it, reads it back, and enters it in the FIR register, providing a free copy.

In Detail

For cognizable offences the police must register the FIR and begin investigation. If a station refuses, the complainant can send the complaint to the Superintendent of Police, approach the Magistrate under Section 223 BNSS, or, in appropriate cases, move the High Court.

Step-by-Step Procedure

  1. 1Report the incident to the police station having territorial jurisdiction.
  2. 2Provide all relevant details, witnesses and documents.
  3. 3Obtain the FIR number and a free copy of the FIR.
  4. 4If refused, escalate to the SP, the Magistrate, or the High Court.

Jurisdiction

Police stations across UP; Magistrate Courts; Allahabad High Court.

Limitations

Police may decline to register an FIR only for non-cognizable matters, in which case a Magistrate’s direction is needed.
